Measures for Rewarding Reports on the Work of River Chief System in Guangzhou

广州市河长制工作有奖举报办法

Article1 These Measures are formulated to combat illegal acts, encourage units and individuals (hereinafter collectively referred to as "Informants") to actively participate in the work of water environment governance and protection of water resources in our city. These Measures are based on the "Water Pollution Prevention and Control Law of the People's Republic of China," the "Environmental Protection Law of the People's Republic of China," the "Regulation on the Administration of Pollutant Discharge Permits," the "Regulation on Urban Drainage and Sewage Treatment," the "Guangzhou Municipal Drainage Regulations," and other laws and regulations, in accordance with the actual situation of our city.

第一条  为打击违法行为，鼓励单位和个人（以下统称“举报人”）积极参与我市水环境治理和水资源保护工作，根据《中华人民共和国水污染防治法》《中华人民共和国环境保护法》《排污许可管理条例》《城镇排水与污水处理条例》《广州市排水条例》等法律法规规定，结合本市实际，制定本办法。

Article2 The Guangzhou Municipal Leading Group Office for the Full Implementation of the River Chief System (hereinafter referred to as "Municipal River Chief Office") is responsible for accepting reports of illegal acts within the administrative area of Guangzhou Municipality and assigning them to relevant functional departments for processing, and rewards informants who comply with the provisions of these Measures.

All relevant functional departments shall verify, investigate, handling the report clues transferred by the Municipal River Chief Office, and report the results back to the Office.

第二条  广州市全面推行河长制工作领导小组办公室（以下简称“市河长办”）负责受理广州市行政区域范围内违法行为的举报并分派给相关职能部门处理，对符合本办法规定的举报人予以奖励。

各相关职能部门依职权核实、查处市河长办移交的举报线索，并将处理结果报市河长办。

Article3 These Measures are applicable when the informant directly reports illegal acts to the Municipal River Chief Office. Reports made to other departments are not included within the scope of these Measures.

第三条  举报人直接向市河长办举报违法行为的，适用本办法；向其他部门举报的，不纳入本办法适用范围。

Article4 The following conducts are incorporated within the scope of rewarded reporting as prescribed in these Measures:

(1) Directly or indirectly dumping and discharging garbage, feces, waste, construction slurry water, construction waste, domestic sewage, pollutants from catering establishments, sludge after sewage treatment, untreated aquaculture waste, industrial wastewater, waste liquid, solid waste, industrial sludge, and other toxic and harmful substances into public drainage facilities, rivers, lakes, reservoirs, ditches and other water bodies in violation of relevant laws, regulations, rules and standards;

(2) Failure to obtain a pollutant drainage permit or pollutant discharge permit in accordance with the law, or failure to discharge sewage to public drainage facilities, rivers, lakes, reservoirs, etc. in accordance with the requirements of the drainage permit or discharge permit;

(3) Unauthorized cessation, dismantling, or idle use of water pollution prevention and control facilities;

(4) Illegal occupation, theft, or destruction of public drainage facilities, water projects, and other related facilities;

(5) Illegal breeding of livestock and poultry within the prohibited areas;

(6) Other violations of laws and regulations that cause damage or pollution to public drainage facilities, rivers, lakes, reservoirs, etc.

Exceptions apply for emergency measures that need to be taken due to "three preventions" (flood, drought, and wind), safe operation of drainage facilities, and other emergencies.

第四条 下列行为纳入本办法规定的有奖举报范围：

（一）违反相关法律法规规章及标准规定，直接或者间接向公共排水设施及河道、湖泊、水库、沟渠等水体倾倒排放垃圾、粪便、废渣、施工泥浆水、施工废弃物、生活污水、餐饮场所污染物、污水处理后的污泥、未经处理的养殖废弃物、工业废水、废液、固体废物、工业污泥、其它有毒有害物质的；

（二）未依法办理排水许可证或排污许可证，或者未按照排水许可证、排污许可证的要求向公共排水设施、河道、湖泊、水库等排放污水的；

（三）擅自停止运行、拆除、闲置水污染防治设施的；

（四）违法实施侵占、盗窃、毁坏公共排水设施、水工程及其他有关设施的；

（五）在畜禽禁养区内非法养殖的；

（六）其它违反法律法规对公共排水设施、河道、湖泊、水库等造成损害或者污染的。

因三防、排水设施安全运行保障等紧急情况需要采取应急措施的除外。

Article5 Citizens, legal entities, or other organizations should report illegal acts preferably with real names and should provide valid contact information. Informants may report objectively and truthfully through phone calls, WeChat official accounts, email,etc, and should try to provide the detailed address of the person being reported, the facts of the violation, the consequences of pollution, and other circumstances as well as relevant evidence such as photos, videos, and written materials.

If necessary, the relevant functional departments may request the assistance of the informant in conducting investigations and gathering evidence.

The specific reporting channels and methods shall be announced to the public by the Municipal River Chief Office.

第五条  公民、法人或者其他组织举报违法行为，提倡实名举报，举报人应提供有效的联系方式。举报人可以通过来电、微信公众号、电子邮箱等方式客观、如实举报，并尽可能提供被举报人的详细地址、违法事实、污染后果等情形及照片和录像、文字资料等相关证据。

必要时，相关职能部门可以要求举报人协助进行调查取证。

具体举报途径方式由市河长办向社会公布。

Article6 Where clues are provided for illegal acts and are found to be valid, a reward of 300 yuan is to be given for each report.

Valid clues refer to providing information on specific circumstances that can be verified, such as the time when the illegal phenomenon was discovered, the place where it was discovered, and the circumstances of the violation, and the content of the report confirmed by the staff to be true.

Where the reports in the preceding paragraph meet the following circumstances, in addition to the rewards described above, the reporter is to be given the following corresponding rewards, and the total amount of rewards is limited to 1 million RMB:

(1) If the reported person is referred to judicial authorities for criminal investigation due to the reported cause, the informant will be rewarded 200,000 yuan;

(2) If the reported person receives an administrative punishment of a fine for the reported matter, a reward of 10% of the amount of the fine is to be given;

(3) If the reported person has not received an administrative penalty of a fine but has been ordered to suspend production or business, or an administrative decision to temporarily withhold or revoke permits or licenses, the informant shall be rewarded with 10,000 yuan; If the reported person receives other types of administrative punishments other than those mentioned above for the reasons being reported, the informant is to be rewarded with 5,000 yuan.

If the processed result of the reported matter meets several criteria as prescribed in the third paragraph of this Article, the reward for the informant shall be based on the larger amount,without cumulative calculation.

In addition to material rewards, informants who report significant violations of law may also be given corresponding spiritual rewards and commendations.

第六条  提供违法行为线索，经认定为有效线索举报的，每次举报奖励300元。

有效线索是指提供了违法现象的发现时间、发现地点、违法情形等可供查证的具体情况信息，并经工作人员确认举报内容为真实。

前款举报符合以下情形的，除上述奖励外，给予举报人如下相应奖励，奖励总额以100万元为限：

（一）被举报人因被举报事由被移送司法机关追究刑事责任的，奖励举报人20万元；

（二）被举报人因被举报事由受到罚款类行政处罚的，按照罚款数额的10%奖励；

（三）被举报人未受到罚款类行政处罚但受到责令停产停业类，暂扣或吊销许可证、执照类行政决定的，奖励举报人10000元；被举报人因被举报事由受到前述以外的其它种类行政处罚的，奖励举报人5000元。

举报事项的处理结果同时符合本条第三款规定的多项标准的，对举报人的奖励以数额较大者为准，但不累加计算。

对举报重大违法行为的举报人，除给予物质奖励外，还可以给予相应的精神奖励及表彰。

Article7 The following cases will not be rewarded:

(1) Reports from the staff of units with water management responsibilities, such as urban administration and comprehensive law enforcement, ecology and  environment, water affairs, agricultural and rural areas, territorial towns and streets, village committees and neighborhood committees, and their close relatives, or reports prompted by them;

(2) Reports transferred and forwarded by higher-level supervisory departments or other departments (units) to the Municipal Water Department or the Municipal River Chief Office;

(3) Cases where the reported behavior was already known to the responsible units such as urban management and comprehensive law enforcement, ecological environment, water affairs, agriculture and rural areas, local towns and streets, village committees and neighborhood committees before the report was made, and is in the process of being dealt with, or has been filed for investigation and has not yet been closed;

(4) Cases that have already been exposed by the news media before the report;

(5) Reports that only reflect illegal phenomena but fail to provide valid clues;

(6) Reports that fail to provide valid contact information.

第七条  下列情形的举报不予奖励：

（一）城市管理和综合执法、生态环境、水务、农业农村、属地镇街、村委会居委会等负有治水职责单位的工作人员及其近亲属的举报或授意他人的举报；

（二）上级主管部门或者其它部门（单位）移送和转送市水务部门或者市河长办的举报；

（三）被举报行为在举报前已被城市管理和综合执法、生态环境、水务、农业农村、属地镇街、村委会居委会等负有治水职责单位知悉，正在处理过程中，或已被立案查处、尚未结案的举报；

（四）举报前新闻媒体已经曝光的；

（五）仅反映违法现象但未能提供有效线索的；

（六）未如实提供有效联系方式的举报。

Article8 Rewards for reporting are based on the following principles:

(1) If multiple people report the same illegal conduct separately and have the same reporting clues, reward the first informant (subject to the time of acceptance and registration);

(2) After the reported illegal conduct is investigated and concluded, where the reported illegal conduct is suspected of repeating again, the report may be continued. Once verified, rewards can be granted again;

(3) Where multiple informants make joint reports, rewards will be given on a case-by-case basis, and the bonuses are to be distributed equally.

第八条  举报奖励遵循以下原则：

（一）对同一违法行为，有多人分别举报且举报线索相同的，奖励最先举报人（以受理登记时间为准）；

（二）被举报的违法行为被查处结案后，再次涉嫌违法行为的，可以继续举报，经核实的，可再次获得奖励；

（三）多个举报人联合举报的，按照一案一奖进行奖励，奖金平均分配。

Article9 The Municipal River Chief Office shall proceed as follows:

(1) Report Acceptance: Upon receiving public reports, staff members should record the reported issues in detail, complete the "Acceptance Form on Rewarding Reports on the Work of River Chief System in Guangzhou" (hereinafter referred to as "the Acceptance Form"), and conduct a review. Reports that comply with the acceptance criteria will be acknowledged while those that do not meet the criteria will be informed to the reporter;

(2) Report Referral: The staff categorize the illegal acts in the "Acceptance Form" and fill out the "Referral Notice on Rewarding Reports on the Work of Guangzhou River Chief System " (hereinafter referred to as the "Referral Notice")  according to their functional division of labor, which is then submitted to the relevant functional departments for investigation and handling within 2 working days;

(3) On-site Investigation: Upon receiving the "Referral Notice", the relevant functional departments should promptly dispatch send someone to the scene to investigate and verify the reported matter, and if it does exist, it should be dealt with in a timely manner;

(4) Feedback on the Processed Results: The Municipal River Chief Office shall review and make a reward decision within 5 working days from the date of receiving the processed results from the functional departments, and inform the informant of the processing.

第九条  市河长办按照以下程序办理：

（一）举报受理：接到公众举报后，工作人员应详细记录群众举报事项，填写《广州市河长制工作有奖举报受理表》（以下简称《受理表》），并予以审查。符合受理条件的举报予以受理，不符合受理条件的告知举报人。

（二）举报交办：工作人员对《受理表》中的违法行为进行分类，根据职能分工填写《广州市河长制工作有奖举报交办通知》（以下简称《交办通知》），在2个工作日内交相关职能部门查处。

（三）现场查处：相关职能部门在接到《交办通知》后，应及时派人到现场调查核实情况，如情况属实，应当及时处理。

（四）处理结果反馈：市河长办在收到职能部门处理结果之日起5个工作日内进行审查并作出奖励决定，并向举报人告知处理情况。

Article10 Informants who meet the reward criteria should proceed to the Municipal River Chief Office within 15 working days after receiving the reward notification to complete the procedures for receiving the reward.

For the small reward amount of 300 yuan, the informant, apart from coming in person or through an authorized representative to the Municipal River Chief Office to complete the reward-receiving procedures, can also fulfill them through the fax and email announced by the Municipal River Chief Office.

Upon verification, the Municipal River Chief Office will distribute the reward to the bank account designated by the reporter via bank transfer within 5 working days. If the informant fails to provide or provides inaccurate information resulting in the inability to distribute or incorrect distribution of the reward, the informant shall bear the consequences.

第十条  符合奖励条件的举报人，应在接到奖励通知15个工作日内到市河长办办理领取奖金手续。

奖励金额为300元的小额奖励，举报人除本人或代理人前来市河长办办理领奖手续外，也可以通过市河长办公布的传真及邮箱方式来办理。

经核实，由市河长办在5个工作日内采取银行转账方式向举报人指定的银行账户发放奖金。因举报人不提供或提供信息不准确导致无法发放或错发奖金的，由举报人自行承担后果。

Article11 The reward funds for reporting shall be incorporated into the departmental budget of the Municipal Water Department and should be allocated and utilized in accordance with the provisions of budget management.

The Municipal River Chief Office should enhance the management of the reward funds for reporting and ensure that they are used specifically for designated purposes. The Municipal Finance and Audit Departments should supervise the use of these incentive funds.

第十一条  举报奖励经费纳入市水务局部门预算，按预算管理的规定安排和使用。

市河长办应加强对举报奖励经费的管理，做到专款专用。市财政、审计部门应对奖励经费使用情况进行监督。

Article12 If the informant has objections regarding case acceptance, investigation, or reward, they should submit their concerns in writing to the Municipal River Chief Office. The Office should respond within 10 working days from the date of receiving the written objection. If there are still objections after the explanation, the informant can legally apply for administrative reconsideration or initiate an administrative lawsuit.

第十二条  举报人对案件受理、查处、奖励等有异议的，应当以书面形式向市河长办提出，市河长办应该在收到书面异议之日起10个工作日内作出解释。经解释后仍然有异议的，举报人可依法提起行政复议或者行政诉讼。

Article13The informant shall be responsible for the authenticity of the content of the report, and where the work of rewarding the report is seriously disrupted by fabricating facts, falsely accusing others, etc., the relevant unit has the right to reclaim the reward amount; and where law-violations or crimes are involved, the informant shall be transferred to judicial authorities for legal processing.

第十三条  举报人应当对所举报内容真实性负责，对捏造事实、诬告他人等严重扰乱有奖举报工作的，有关单位有权收回奖励金额；涉及违法犯罪的，依法移送司法机关予以处理。

Article14 Relevant staff members must strictly adhere to confidentiality protocols, ensuring the informant's information is kept confidential and not disclosing any information related to the reported matter.

第十四条  相关工作人员应严格遵循保密纪律，对举报人信息保密，不得泄露与举报事项有关的任何信息。

Article15If government departments and their staff fail to perform their duties in accordance with these Measures, the higher administrative organ or relevant departments shall shall order them to make corrections and circulating a notice of criticism. If the circumstances are serious, the directly responsible person in charge or other directly responsible persons shall be punished according to law.

第十五条 政府部门及其工作人员不依照本办法履行职责的，由上级行政机关或者有关部门责令改正、通报批评；情节严重的，对直接负责的主管人员或者其他直接责任人依法给予处分。

Article16 These Measures shall come into force from the date of issuance and shall be valid for five years. "Notice of the Guangzhou Water Authority on Issuing the Measures for Rewarding Reports on the Work of River Chief System in Guangzhou" (Guangzhou Water Regulations [2020] No.2) shall be repealed at the same time.

第十六条 本办法自印发之日起施行，有效期五年。《广州市水务局关于印发广州市违法排水行为有奖举报办法的通知》（穗水法规〔2020〕2号）同时废止。
